Virginia's New DUI Laws

| 1st offense BAC .15-.20 | 5 days mandatory jail |
| 1st offense BAC .20-.25 | 10 days mandatory jail |
| 1st offense BAC .25 and above | 10 days mandatory jail |
| 2nd offense within 5 years of first BAC .20- or greater | 20 days mandatory jail |
| 2nd offense of refusal to submit to a BAC or blood test | For second offense within 10 years, 3 years loss of license and criminal conviction of Class 2 misdemeanor. For third or subsequent offense in 10 years, 3 years loss of license and criminal conviction of Class 1 misdemeanor |
| 2nd offense within 5 – 10 years of a previous DUI conviction | 10 days mandatory jail |
| 2nd offense within 5 – 10 years BAC.20 or greater of a previous DUI conviction | 20 days mandatory jail |
| 3rd offense in 5 – 10 years of a previous DUI conviction | 3 months mandatory jail |

| Arrest away from incident | Allow for arrest without warrant if probable cause exists that driver was driving under the influence and arrest occurs within 3 hours of the commission of the offense |
| Previous offender driving with alcohol on breath | Any person who is found guilty of operating under a suspended or restricted license, and who has a BAC .02, will require suspension of the license for an additional 1 year with no ability to drive for any reason |
