Virginia's New DUI Laws

 

FACTS LAW ( effective July 1, 2004 )
1st offense Blood Alcohol Concentration (BAC) .08-.15 0 to 12 months jail, restricted license
1st offense BAC .15-.20 5 days mandatory jail
1st offense BAC .20-.25 10 days mandatory jail
1st offense BAC .25 and above 10 days mandatory jail
2nd offense within 5 years of first BAC .20- or greater 20 days mandatory jail
2nd offense of refusal to submit to a BAC or blood test For second offense within 10 years, 3 years loss of license and criminal conviction of Class 2 misdemeanor. For third or subsequent offense in 10 years, 3 years loss of license and criminal conviction of Class 1 misdemeanor
2nd offense within 5 – 10 years of a previous DUI conviction 10 days mandatory jail
2nd offense within 5 – 10 years BAC.20 or greater of a previous DUI conviction 20 days mandatory jail
3rd offense in 5 – 10 years of a previous DUI conviction 3 months mandatory jail
3rd offense within 5 years of a previous DUI conviction 6 months mandatory jail
4th or subsequent offense within less than 10 years of a previous DUI conviction 1 year mandatory jail
Ignition Interlock Required use for all offenders .15 BAC and above
Forfeiture of automobile 3rd or subsequent offender’s MOTOR VEHICLE CONFISCATED
No Bail for fourth or subsequent offenders No bail/bond
Arrest away from incident Allow for arrest without warrant if probable cause exists that driver was driving under the influence and arrest occurs within 3 hours of the commission of the offense
Previous offender driving with alcohol on breath Any person who is found guilty of operating under a suspended or restricted license, and who has a BAC .02, will require suspension of the license for an additional 1 year with no ability to drive for any reason

Car Towed                                $150

Hiring Attorney                        $1,000 -$4,000

Court Fines/Cost                      $250 - $2,500

Restricted License                    $120

Alcohol-Education Class Fee    $300 - $1,000

Insurance Rate (Increase per year)     $1,000 - $2,000

Felony Conviction                    Loss of Rights to Vote & Bear Arms

TOTAL: Minimum $5,000 to $20,000
